This Privacy Policy is designed to help you understand how KPI Consulting Fund d/b/a CASA, (collectively, “CASA,” “we,” “us,” “our”), collect, use, and share your personal information and to help you understand and exercise your privacy rights in the course of your use of the web site at www.thecasacommunity.com and all associated sites linked to CASA (collectively, the "Site").

When you visit our Site, and more generally, use any of our services (the “Services,” which include the Site and the intake form), we appreciate that you are trusting us with your personal information.  We take your privacy very seriously.  If there are any terms in this Privacy Policy that you do not agree with, please discontinue use of our Services immediately.

This Privacy Policy applies to all information collected through our Services, as well as any related services, sales, marketing or events.

WHAT INFORMATION DO WE COLLECT?

In the course of your use of the Services, we obtain the following information about you as described below. 

Information you voluntarily provide to us

We collect the following information from you when you provide it to us:

  • Information that you provide during filing out the intake form, your name, email address, phone number, school’s name, gender or age. 

  • Information and content provided to or acquired by support, including but not limited to information and content provided or acquired through email or phone calls. 

  • Information you provide, when you call or email us (for support or otherwise) or when you use our products or Services.

Information we collect about your usage and devices

We collect data relating to your online activity on our websites, including the following:

  • Your IP address, browser type and version, geographic location and operating system version.

  • Any device or other method of communication you use to interact with our Services including device identifiers.

  • How you got to our Services and any links you click on to leave.

  • Pages you view including your interactions with any videos we offer. 

  • When you update your information, communicate with us or order new Services.

  • Metadata about your use of our Services and emails we send to you (including clicks and opens).

  • Metadata about how your customers, contacts and users interact with the Services we provide you.

  • Issues you encounter requiring our support or assistance.

We store the data we collect in a variety of places within our infrastructure, including system log files, back-end databases and analytics systems.

We also collect the following information from other sources:

  • Information you provide to us at events or to our partners.

We may collect and store demographic information (such as your zip code, gender, date of birth, and/or age), and use this data to tailor your experience on our websites, ensure you are at least 18 years of age to provide content that we think you might be interested in, perform general improvements to the websites, and display the content according to your preferences. Such demographic information may be shared with partners, market researchers and other third parties on an aggregate and non-personally identifiable basis. No personally identifiable information will be linked to such aggregated demographic information that is shared with third parties except with your explicit consent.

We also collect information that you may provide during your telephone conversations with us, which we may monitor or record.

We do not collect any academic records or institutional student records from the schools, unless explicitly consented by you.

We use the information we collect, both on its own and combined with any other information we collect about you, for the following business and commercial purposes:

  • To provide the requested Services to you.

  • To provide you with useful content.

  • To ensure the proper functioning of our Services.

  • To facilitate your movement through our websites or your use of our Services.

  • To do a better job of advertising and marketing our Services (subject to your consent where required by applicable law).

We also use the information we receive to produce reports on trends and statistics, such as mobile search trends, email open rates by industry, campaign best practices or the number of users that have been exposed to, or clicked on, our websites or evaluated or purchased our products or Services.

Sharing of information

We share your personal information according to this Privacy Policy, with your consent or as necessary to provide you the Services you request, as well as to operate our business. As further described below, we will only share certain personal information with:

  • Real Estate Brokers.

  • Third party service providers and vendors.

  • In connection with a sale, merger, acquisition or corporate reorganization.

  • Law enforcement, government officials and authorized individuals for legal reasons.

More specifically, we may need to process your data or share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Real Estate Brokers, Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: finding appropriate real estate brokers, facilitating lease agreements, data analysis, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Site, which will enable them to collect data on our behalf about how you interact with our Site over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity. Unless described in this policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes. 

  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

  • Business Partners. We may share your information with our business partners to offer you certain products, services or promotions.

HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Site is at your own risk. You should only access the Site within a secure environment.

We may process and store your personal data in countries outside of your country of residence, including in the United States. These countries may have data protection laws that are different from the laws of your jurisdiction. Where required by law, we ensure that appropriate safeguards are in place when personal data is transferred internationally. By using our services or providing us with your personal data, you acknowledge and agree to the transfer, processing, and storage of your data in accordance with this Privacy Policy.

DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Site, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Site. If we learn that personal information from users less than 18 years of age has been collected, we will delete the intake form and take reasonable measures to promptly delete such data from our records. WHAT ARE YOUR PRIVACY RIGHTS?

You Have Certain Choices About How We Use Your Information.

You can opt out of certain marketing. To stop receiving our marketing communications please email us at hello@thecasacommunity.com or follow the instructions in any message you get from us.

You can restrict how we share information with third parties. If you do not want us to share information with third parties for their direct marketing purposes, you can contact us at the email or address listed at the end of this Policy. Please mark your inquiries "Third-Party Marketing Opt-Out.".

You have a right to access, update or delete your information, the right to restrict our processing in certain circumstances and the right to get a copy of your information to take to another company. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy. 

DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

DO WE MAKE UPDATES TO THIS PRIVACY POLICY?

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
